These Terms of Service govern your use of eclatco.shop and any purchase you make from Éclat & Co. (“we”, “us”). By using our website or placing an order, you agree to these terms. Please also read our Privacy Policy and our Return & Refund Policy, which form part of these terms.

1. Our jewelry

Many of our pieces are one of a kind or made in very small numbers. We make every effort to show each piece accurately; however, colors may look slightly different depending on your screen, and stated weights and measurements may vary slightly. Where a piece is sold with a gemstone certificate or report, this is stated on its page.

2. Prices and availability

Prices are shown in U.S. dollars. Because our pieces are also offered in our Miami showroom, availability is subject to prior sale. If a piece is no longer available, or if a price or description was listed in error, we may cancel the order and issue a full refund of any amount paid.

3. Orders and payment

An order is accepted when we confirm it. We may contact you to verify your identity or payment details before shipping, especially for high-value orders, and we may decline or cancel an order at our discretion, in which case any payment will be refunded in full. Payments are processed securely by our payment provider.

4. Taxes and duties

Applicable sales tax is shown at checkout. International orders may be subject to import duties, taxes and fees charged by the destination country; these are the responsibility of the recipient.

5. Shipping, returns and final sale

Returns, refunds, exchanges, shipping and cancellations are governed by our Return & Refund Policy. Eligible, non-customized jewelry may be returned within 7 calendar days of confirmed delivery. All customized, personalized and made-to-order jewelry is final sale, except where remedies are required by law.

6. Bespoke and custom orders

For bespoke pieces, the design, timeline, price and payment schedule are agreed with you in writing before work begins. Because each custom piece is created exclusively for you, custom orders are final sale, as described in our Return & Refund Policy.

7. Intellectual property

All content on this website — including photographs, designs, text, logos and graphics — belongs to Éclat & Co. or its licensors and may not be copied or used without our written permission.

8. Use of the website

You agree not to misuse our website, including by attempting to interfere with its operation, accessing it by automated means, or using it for any unlawful purpose.

9. Limitation of liability

To the fullest extent permitted by law, Éclat & Co. will not be liable for any indirect, incidental or consequential damages arising from your use of the website or your purchase, and our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these terms limits any rights you have under applicable consumer protection law.

10. Governing law

These terms are governed by the laws of the State of Florida, United States. Any dispute will be handled by the courts located in Miami-Dade County, Florida.

11. Changes to these terms

We may update these terms from time to time. The version posted on this page at the time of your order applies to that order.
